Like many Americans, my finances got out of control during the tough economic times of the past few years. The cause of my experience is nothing new or unique, but what I did about it is.

I made some poor financial decisions, overextended myself on my credit cards, and ended up owing money to a company called Resurgent Capital Services. Apparently they had bought an old auto loan from my original creditor, and now they expected me to pay back the debt plus a truly shocking amount of interest and fees. At that point, paying was simply not an option. I didn’t have a dime to spare.

As time passed, Resurgent Capital Services got more and more aggressive about securing repayment on the debt. They began calling multiple times each day, and sent a whole pile of mail. I tried to screen my phone calls, but every once in a while I would end up on the phone with someone claiming to be from Resurgent Capital Services. Their demands got increasingly harsh, and they even started to make threats against me and my family. They said I had to give them my bank account information and authorize automatic payments, or they would have me arrested.

I quickly got fed up with this poor treatment. I often asked to speak with a supervisor, and my call would be placed on hold for half an hour and then mysteriously dropped. One day I looked up Resurgent Capital Services online and started calling all of their listed numbers. When I got through to someone, they confirmed that I did have an outstanding collections account with them. When I complained about the way the phone reps had been treating me, I was informed that those reps were not actually Resurgent Capital Services employees. I had been targeted by a scam!

Apparently, it is becoming increasingly common for scam artists to get hold of collection lists and then attempt to extort money out of debtors. The real Resurgent Capital Services representative told me that real debt collectors would never violate the Fair Debt Collection Practices Act, which states that debt collectors cannot:

-threaten to have you arrested without due process
-threaten to freeze your assets or garnish your wages without due process
-threaten to take action against your family
-call you for the sole purpose of annoying you
-call your employer (if you’ve told them not to)
-continue calling you once they’ve been informed that you are represented by a lawyer

If you get a call from someone who seems to be violating the Fair Debt Collection Practices Act, be aware that it may very well be a scam. Do not, under any circumstances, give them your bank account number, social security number, or any other personal or financial details. The scammer’s goal is to get enough information to be able to steal money from your bank account. Don’t let that happen!

I was really shaken up by the news that I had been targeted by a scam. However, I had to wonder how they got their information in the first place! How did that scammer know that I really did owe Resurgent Capital Services? It is somewhat of a mystery, and it makes me wonder about my security and privacy.

The real Resurgent Capital Services also wanted me to repay my debts, but they showed a little more finesse in their tactics. They tried to convince me that they had my best interests at heart and were just trying to help me get out of debt as painlessly as possible. They proposed a payment plan with really low monthly payments. It seemed great at first, but then I realized that the payments would stretch on for years and I would end up paying an outrageous amount of interest!

I quickly came to my senses and realized that I was not going to get any real help from Resurgent Capital Services. They were just pushing their own agenda: making as much money as possible!

I stopped taking any phone calls from anyone. For a while it seemed like I could just avoid the problem, but then I got a disturbing letter in the mail from TransUnion. It notified me that a collection item had been added to my credit report by Resurgent Capital Services. That collection item lowered my credit score by over 100 points!

Since bad credit affects many aspects of your life, it’s definitely not something you can just avoid. Even if you’re willing to live a cash-only life and give up on any chance of getting financing for a house, a car, or other big ticket purchase, there is still the issue of how bad credit affects your professional image. Many employers have adopted the strategy of looking at job applicants’ credit reports before hiring. I knew that I would have to do something about my bad credit.

I thought maybe I could find that answer to my problem online. I looked up credit repair services, and I found a ton of companies claiming to offer top-notch credit repair services. Most of them required huge up-front payments, with no guarantee that they would actually be successful. To me, that is the earmark of another type of scam!
